Destiny Garcia charged with murdering mom and mom's boyfriend looks unimpressed as case is delayed
A teenager accused of killing her mother and the parent’s boyfriend, then leaving the bodies to rot while she attended a New Year’s Eve party, appeared in a New York court Thursday.
Destiny Garcia was 15 when she allegedly shot then stabbed mother Rosie Sanchez to death and did the same to Anderson Nunez, helped by her 28-year-old boyfriend Jerry Masionett.
After requesting a separate trial from the accused man – who fathered a child she miscarried after the murders – Garcia was in the Brooklyn court for a routine status conference.

Charged with two counts of murder, Garcia stood before Judge Miriam Cyrulnik for a brief update on the scheduling of her case.
The defendant wore her khaki green prison garments over a long-sleeve gray ensemble.
She left her rosary beads visible over the top, donned black-framed spectacles and wore her long black hair down in an unkempt fashion.
She was appearing alongside her lawyer Peter Guadagino. At one point she shot an unimpressed facial expression at him as he spoke to her while pointing his finger in her direction.

A law enforcement officer also kept a close eye on Garcia, who remained bound to handcuffs and appeared to try her best to maintain a serious facial expression.

The defendant was told she would be scheduled to return to court in April.
Garcia has admitted to the murders.

Three years ago her attorney claimed in court the teen was being harassed by fellow inmates at the juvenile facility where she was being held.
She was ordered into protective custody.
Garcia had initially implicated her godbrother Jordan Santiago in her first statement on January 3 but in her second statement - given the next day - she then removed Santiago and included her boyfriend Jerry Maisonett as the accomplice, said the New York Daily News.
The teen went on to describe how her mother had physically abused her and how she had planned to go and live with a cousin.

On the night of the killing, Sanchez apparently caught Garcia with her bags packed and after the pair got into an argument, her mother apparently punched her in the face several times, according to a statement obtained by the newspaper.
Following the argument, she then called her boyfriend and asked him for a gun 'for protection', which he is said to have brought to her on the night of the 28th.
The 15-year-old then attended New Year's Eve celebrations in Times Square while her mother and step-father's corpses were rotting in the family apartment, investigators say.
Maisonett has been indicted for the murders and faces life in prison without the possibility of parole if convicted.
The account, reported by the New York Daily News, revealed that on that night Sanchez had beaten Garcia, before going back into her bedroom.
Garcia then got the gun from a drawer and went into her mother's bedroom and shot at her, which after a second attempt, hit Sanchez in the neck.
